Terms of Service
These Terms of Service ("Terms") govern the relationship between [Your Company Name], referred to as "the Company," and you, the user, in connection with the use of our services and the participation in our tours. By booking a tour with us or using our services, you agree to these Terms. Please read them carefully.
- Booking and Payment: To book a tour with Pride Adventure Travel, you must provide all required information and make the necessary payments as outlined. A $500 deposit is required at booking. Payment plans start approximately 9 months before the trip, with full payment due 90 days before departure. Payments are evenly split, and additional options must be paid in full 90 days before the trip. Failure to provide requested information or complete payments may result in additional costs or booking cancellation. The Company reserves the right to change rates or cancel bookings for non-payment.
- Travel Documents: It is your responsibility to obtain all necessary documentation and identification for entry, departure, and travel to each country or region visited during the tour. This includes a valid passport and any visas, permits, or certificates required by relevant authorities. Your passport should be valid for at least six months after the tour's end date as specified in your itinerary. Failure to obtain proper documentation may result in additional costs or inability to participate in the tour.
- Flexibility & Unused Services: Adventure travel often requires flexibility due to unforeseen circumstances. While we strive to adhere to planned itineraries, changes may occur due to factors beyond our control, such as weather conditions or logistical challenges. In such cases, reasonable alterations to products, services, or itineraries may be necessary. Please note that services missed or unused after departure due to circumstances beyond our control are non-refundable.
- Changes: We reserve the right to modify itineraries when necessary to ensure the safety and enjoyment of our clients. Material changes, such as significant alterations to the itinerary or services, will be communicated to you as soon as possible. In the event of a material change, you may choose to accept the amended itinerary, book an alternative product or service, or cancel your booking for a full refund. Once a tour has commenced, itinerary changes may be made based on operational concerns or unforeseen circumstances.
- Cancelation & Refund Policy: For international trips, cancellations within 0-90 days prior to the trip are non-refundable, and travelers must have trip insurance. Cancellations between 91-180 days before the trip may result in an 85% refund or a $350 fee, whichever is less, covering all associated transfers, etc. Cancellations made 181 or more days before the trip will result in a 100% refund after a $150 non-refundable fee. For domestic trips, cancellations within 0-90 days prior to the trip are non-refundable, requiring travelers to have trip insurance. However, cancellations made 91 or more days before the trip will result in a 100% refund after a $150 non-refundable fee. Any non-refundable government or vendor fees, such as permits or deposits, will not be refunded if they are non-refundable and non-transferable.
- Acceptance of Risk: Adventure travel inherently involves risks to health and safety, and by participating in our tours, you acknowledge and assume these risks. This includes risks associated with physical activities, remote locations, and travel to developing regions. We require all participants to complete a participation waiver acknowledging their assumption of these risks. While we take measures to ensure your safety, you are ultimately responsible for understanding and accepting the risks associated with your chosen tour.
- Third-Party Suppliers: We collaborate with various third-party suppliers to provide components of our tours, such as accommodation, transportation, and activities. While we carefully select our suppliers, we cannot control or supervise their actions. Therefore, we are not liable for any acts or omissions of third-party suppliers, including any loss, damage, or inconvenience caused by their services. Third-party suppliers operate under their terms and conditions, which may limit their liability.
- Accommodations Changes: We and our tour providers reserve the right to modify accommodations to options of a similar standard at any point before or during the trip. However, please be assured that we will always endeavor to book accommodations that are at the same level of service or better whenever possible. This flexibility allows for adjustments based on availability and unforeseen circumstances to ensure a comfortable and enjoyable experience for all travelers.
- Optional Extras: Optional extras refer to additional activities, transportation, meals, or services not included in the tour itinerary. While we may assist in arranging these extras upon request, participation is entirely voluntary, and we assume no liability for any associated risks. Clients are responsible for any costs or liabilities incurred from participating in optional extras, and we recommend assessing the potential risks before booking.
- Liability: Our liability is limited in accordance with applicable laws and international conventions. While we strive to provide a safe and enjoyable travel experience, we cannot guarantee absolute safety. Therefore, we are not liable for any loss, damage, or injury arising from factors beyond our control, such as acts of nature, political unrest, or the actions of third parties. Clients are encouraged to obtain travel insurance to mitigate potential risks.
- Force Majeure: We are not liable for failure to perform our obligations under the contract in cases of force majeure, including but not limited to natural disasters, acts of terrorism, or government restrictions. Force majeure events may make it unsafe or impractical to continue with the tour, and in such cases, we reserve the right to cancel or modify the itinerary as necessary for the safety of our clients. We recommend obtaining comprehensive travel insurance to cover unforeseen circumstances.
- Images and Marketing: You agree that, while participating in any tour, images, photos, or videos may be taken by other participants, the Company, or its representatives that may contain or feature you. You consent to any such pictures being taken and grant a perpetual, royalty-free, worldwide, irrevocable license to the Company to reproduce them for any purpose whatsoever, without further obligation or compensation payable to you.
- Privacy Policy: We collect your personal information to deliver the tour and any products or services booked. We collect, use, and disclose only that information reasonably required to enable us and our third-party suppliers to provide the particular tour, products, and/or services that you have requested as described in our Privacy Policy. By submitting any personal information to us, you indicate your acceptance of our Privacy Policy.
- Severability: If any provision of these Terms is so broad as to be unenforceable, such provision will be interpreted to be only so broad as is enforceable. The invalidity or unenforceability of any provision hereof will in no way affect the validity or enforceability of any other provision.
- Contract Parties & Successors: These Terms will inure to the benefit of and be binding upon the parties and their respective heirs, legal and personal representatives, executors, estate trustees, successors, and assigns.
- Applicable Law: The Contract and these Terms are subject to the laws of [Your Jurisdiction], and you submit to the exclusive jurisdiction of the courts located in [Your Jurisdiction] for the resolution of any dispute under these Terms or concerning any tour, product, or service.
- Amendments: The Company reserves the right to update or alter these Terms at any time, and will post the amended Terms on the Company’s website. Any amendment will take effect 10 days after being posted to the Company’s website. An up-to-date copy of these Terms, as amended, may be accessed at any time on the Company’s website and will be sent to you upon written request to the Company.
